Two years later, it purchased the WhatsApp for $19 billion.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">&#8220;The [FTC&#8217;s] argument is the acquisition of Instagram was a way of neutralising this rising competitive threat to Facebook,&#8221; says Rebecca Haw Allensworth, a professor of antitrust law at Vanderbilt Law School.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Ms Allensworth says Mr Zuckerberg&#8217;s own words, including those from his emails, may offer the most convincing evidence at trial.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">&#8220;He said it&#8217;s better to buy than to compete. It&#8217;s hard to get more literal than that,&#8221; Ms Allensworth says.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">On Monday, Matheson referenced a 2012 memo from Zuckerberg in which he discusses the importance of &#8220;neutralising&#8221; Instagram. Matheson called the message &#8220;a smoking gun.&#8221; <!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Meta, on the other hand, said the purchases made the consumer experience better.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">&#8220;Acquisitions to improve and grow&#8221; have never been found unlawful, Hansen said Monday, &#8220;and they should not be found unlawful here.&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">The company maintains that it faces competition from a slew of other apps, including TikTok, X, YouTube, and iMessage.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Mr Zuckerberg and the company&#8217;s former chief operating officer Sheryl Sandberg are both expected to testify at the trial, which could run for several weeks.<!-- --><\/p>\n<\/div>\n<p><h2 class=\"sc-518485e5-0 DkKTF\">Shifting politics<!-- --><\/h2>\n<\/p>\n<div data-component=\"text-block\" class=\"sc-18fde0d6-0 dlWCEZ\">\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">The case, FTC v Meta, was filed during US President Donald Trump&#8217;s first administration but risks becoming politicised during his second term.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Mr Zuckerberg has lobbied Trump in person to have the FTC drop the case, <!-- --><a target=\"_blank\" href=\"https:\/\/www.wsj.com\/politics\/policy\/meta-antitrust-trial-zuckerberg-lobbying-trump-67c8f3a5\" class=\"sc-c9299ecf-0 beIoQm\">according to the Wall Street Journal<!-- --><\/a>.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">When asked by the BBC to confirm that report, Meta sidestepped the question but said in a statement: &#8220;The FTC&#8217;s lawsuits against Meta defies reality.&#8221;<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">&#8220;More than 10 years after the FTC reviewed and cleared our acquisitions, the commission&#8217;s action in this case sends the message that no deal is ever truly final,&#8221; a Meta spokesperson told the BBC.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Relations between Mr Zuckerberg and Trump had been frosty partly because Trump was barred from Meta&#8217;s social media platforms after the US Capitol riot in January 2021.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Since then, the relationship has <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.com\/news\/articles\/c627p8leww1o\" class=\"sc-c9299ecf-0 beIoQm\">thawed somewhat.<!-- --><\/a><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Meta <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.com\/news\/articles\/c8j9e1x9z2xo\" class=\"sc-c9299ecf-0 beIoQm\">contributed<!-- --><\/a> $1m (\u00a3764,400) to Trump&#8217;s inaugural fund, and has added former Trump adviser Dina Powell McCormick and Ultimate Fighting Championship (UFC) boss Dana White, a Trump ally, to Meta&#8217;s board of directors this year.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">The company also <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.com\/news\/articles\/cly74mpy8klo\" class=\"sc-c9299ecf-0 beIoQm\">announced<!-- --><\/a> in January that it was doing away with independent fact-checkers and had <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.com\/news\/articles\/c79d74nppvpo\" class=\"sc-c9299ecf-0 beIoQm\">agreed to pay<!-- --><\/a> Trump $25 million to settle a lawsuit over the suspension of his accounts after the 6 January Capitol riots in 2021.<!-- --><\/p>\n<\/div>\n<p><h2 class=\"sc-518485e5-0 DkKTF\">&#8216;A very clear message&#8217;<!-- --><\/h2>\n<\/p>\n<div data-component=\"text-block\" class=\"sc-18fde0d6-0 dlWCEZ\">\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">President Trump&#8217;s move to fire two FTC commissioners in March also hangs over the case.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">As Democrats, Rebecca Kelly Slaughter and Alvaro Bedoya were in the minority on the five-seat commission.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fezwLZ\">Until Wednesday, just two seats of those seats were filled, both by Republicans.
