If they complete it, they can have their charges dismissed or reduced.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">It comes as prisons across the country are struggling to deal with overcrowding after the number of offenders behind bars hit a record high.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The Labour government has been exploring options to relieve the immediate pressure on prisons, and has already <!-- --><a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c23ljkrx0e2o#:~:text=Under%20the%20release%20scheme%2C%20announced,sentences%2C%20instead%20of%2050%25.\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">released some offenders early<!-- --><\/a> to free up space.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But further emergency measures to stop prisons breaching capacity will be needed next year, sources have told the BBC.<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\" class=\"sc-18fde0d6-0 dlWCEZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Ministers had hoped the existing early release scheme would buy them 12 months.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But the riots this year mean prisons are expected to be full again next summer, before any changes to sentencing can be made.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">In the long term, ministers want to consider sentencing changes that could reduce crime.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Ending or moving away from short sentences could have a particular effect on the number of women in jail, after the Prison Reform Trust found last year that over half (58%) of jail terms given to women in 2022 were for less than six months.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\"><a target=\"_blank\" href=\"https:\/\/www.gov.uk\/government\/statistics\/proven-reoffending-statistics-july-2022-to-september-2022\/proven-reoffending-statistics-july-to-september-2022\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">Ministry of Justice figures show<!-- --><\/a> more than half of adults (57%) released from prison sentences of less than 12 months went on to reoffend.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">One Ministry of Justice source said the government would be encouraging the reviewer \u201cto follow the evidence in terms of how sentencing can cut crime\u201d.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cPrisons are creating better criminals, not better citizens,\u201d the source said.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">A solicitor who was seen as being on the centrist wing of the Conservative Party, Gauke could be viewed as a contentious choice to lead the review.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">In 2019, he made a series of speeches to call for a shift away from short prison sentences and towards punishment in the community.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">But Gauke\u2019s successor, Robert fYAfXe\">Lord Woolf, a former chief justice of England and Wales, told the BBC he thought Gauke would be a \u201cvery good person\u201d to lead the sentencing review.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">He said the government should consider launching a public inquiry into the penal system.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cI think there is ignorance over what prisons can achieve,\u201d he said.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">He wrote a report about the Strangeways prison riot in 1990 and has consistenly highlighted the problems of prison overcrowding since then.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The retired barrister was one of five former lord chief justices who signed <!-- --><a target=\"_blank\" href=\"https:\/\/www.russellwebster.com\/sentencing-inflation\/\" class=\"sc-c9299ecf-0 bZUiKB\" rel=\"noopener\">a paper<!-- --><\/a> that blamed \u201csentence inflation\u201d for the lack of space in prisons.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cThe public want longer and longer sentences,\u201d Lord Woolf said. \u201cBut they don\u2019t know that\u2019s self-defeating and it\u2019s a very expensive policy.\u201d<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Tory leadership contender Kemi Badenoch criticised Labour for &#8220;taking short-term decisions and putting the public at risk&#8221;, adding she wanted to tackle the &#8220;root causes&#8221; of prison overcrowding.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Robert Jenrick, the other remaining candidate in the leadership contest, said Labour was showing a &#8220;soft-on-crime approach&#8221;, and repeat offenders needed &#8220;massively tougher sentences&#8221; to protect the public.<!-- --><\/p>\n<\/div>\n<div data-component=\"text-block\" class=\"sc-18fde0d6-0 dlWCEZ\">\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Other previous justice secretaries &#8211; including Ken Clarke &#8211; have talked up changes to sentencing, only to be stymied by political opposition or the electoral calendar.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The previous Conservative government\u2019s attempt to bring in \u201ca presumption that custodial sentences of 12 months or less be suspended\u201d was dropped after the general election was called earlier this year.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">Speaking at Labour\u2019s conference last month, Lord Timpson, the prisons minister, said community sentences need \u201cto be trusted more by the courts\u201d as an alternative to jail.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">He suggested previous prisons ministers had not always followed the evidence on \u201cthe best way to stop reoffending\u201d.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">The government has not made any decisions on potential changes to sentencing policy and will not do so until it has considered the recommendations of the review.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">A Ministry of Justice spokesperson said: \u201cThe lord chancellor has confirmed plans to launch a review into sentencing that will focus on protecting the public and reducing reoffending.<!-- --><\/p>\n<p class=\"sc-eb7bd5f6-0 fYAfXe\">\u201cWe will soon be in a position to announce the terms of reference for this independent review and
